Pa. plumbing, HVAC business settles attorney general lawsuit over scare tactics, unneeded work
Terms of the settlement include the company paying $700K in restitution. A Pittsburgh area plumbing and HVAC business, Gillece Plumbing and Heating, has settled a lawsuit alleging it used "scare tactics" and misled consumers into unnecessary work, including sewer pipe replacements. The defendants, Thomas Gillec Sr., trainer Thomas Gilece Jr. and two former technicians, will pay $700,000 in restitution to consumers, $50,000 costs, and $250,000 suspended civil penalties. The lawsuit accused Gilleced of luring customers with sewer back-ups using a $93 for Free Clog Crusher Special, but when technicians went to homes, customers were told their clogs could not be fixed and expensive excavation work was needed. The company also failed to allow customers to cancel contracts within three days and made false or misleading claims in ads and offers, and misrepresented its flat-rate pricing. The consent order includes strict certification of plumbing and hVAC technicians, requiring any technician selling sewer excavation work or hydro jets to be certified in the National Association of Sewer Service Companies' lateral assessment certification program.
